Irish Continental Technology Limited(‘ICT’) – Standard Terms and Conditions Relating to Telephony Services

1) These terms and conditions apply to the purchase of telecom services by you fromICT in exchange for some or all the credit remaining on credit vouchers distributed by ICT. Throughout these Terms and Conditions, ‘you’ includes any person implicitly or explicitly authorised to purchasetelecom services, in exchange for credit on credit vouchers distributed by ICT.

Our agreement

2) This agreement begins, and these Standard Terms and Conditions are effective and deemed accepted, when you agree to pay for telecom services using some or all of the credit available on acredit voucher distributed by ICT. You are deemed to have agreed to contract and pay for telecom services by the following action:

i) entering the unique PIN allocated to each pre-paid credit voucher before making a phone call;

3) There will be a separate charge, and the commencement of a separate contract, for each telecom service purchased. Charges (being the charges for services that you use) will be applied to this account until such time as all credit available on that account has been used or expired.

Providing services

4) We will try to ensure the services are made available to you, but sometimes they may be affected by things we cannot control, for example, the weather, interruptions to services from suppliers and faults in other IT networks. Certain services may be suspended but we will endeavour to give as much notice of this as practical.

5) The services are made available provided:

i) they are not used for anything illegal, immoral or improper;

ii) they are not used to make offensive or nuisance calls;

iii) they are only used with equipment approved for use with the network (and which have not been lost or stolen) and all relevant laws and rules are followed;

iv) you provide information reasonably asked for from time to time and do not give any false information;

v) all reasonable instructions given to you are followed;

vi) all deposits relating to that element of the the credit voucher being used to pay for the telephone call have been received by us

Charges for Telephony Services

6) Please refer to the website www.fntele.ie for latest charging terms and conditions.

7) Rates are applicable 24/7 and where appropriate, include applicable VAT

8) Rates and billing conditions are subject to change without any prior notice; this may be due to circumstances outside our control, such as changes to wholesale prices that we are charged by third party suppliers.

9) Charges may vary from some public and mobile phones; we recommend that customers check the relevant charges with their mobile provider before using this product.

10) Different rates may apply for calls made to some premium numbers, non-geographical numbers and mobile numbers.

11) Your service provider may charge you for using our national and international access numbers; we recommend that you check with your supplier before using this product..

Monitoring of calls

12) Calls received by the Company may be monitored and recorded. This may be done to improve the service which is provided, to ensure compliance with practices and procedures and where, for example, a contract is entered into by such call and the recording will provide evidence of the transaction.

Disclosure of Personal Information

13) Where we have told you in advance, certain information may be disclosed to third parties such as the network service provider for purposes solely connected with the provision of service via their networks. Where required or permitted by law, information may be provided to others, such as the Police or the relevant Tax Authorities.

Protection of Your Personal Information

14) We use strict security measures in order to protect personal information. From time to time, this may include checking your identity when you telephone us, encrypting data on our websites and other measures in order to ensure compliance with all applicable legal requirements.

15) ICT may contact you via SMS from time to time with details of current sales and promotions. To opt out of these SMSs, please contact out customers services on 01 2477829. ICT will not share your data with any third party

Liability

16) We are only liable to you as set out in this agreement. We have no other duty or liability to you.

17) Except in the case of paragraph y, our maximum liability to you for something we or anyone who works for us does or does not do will be limited to £1,000 for one incident, or £2,000 for a number of incidents within any 12 month period.

18) We are not liable to you in any way for any loss of income, business or profits, or for any loss or damage that was not reasonably foreseeable at the time you entered this agreement.

19) We will not be liable to you if services cannot be provided because of something beyond our control.

20) Nothing in this agreement shall exclude or restrict Irish Continental Technology Limited’s liability for death or personal injury resulting from the negligence of Irish Continental Technology Limited or it’s employees.

21) This section will apply even after this agreement has ended.

When we may suspend or disconnect the services

22) Any of the services may be suspended or made unavailable without warning if:

a) our systems break down or need maintenance. We will try to make sure this does not happen often;

b) You do not keep to the conditions of this agreement, or any other agreement with us;

c) you damage the network or puts it at risk, or abuses or threatens our staff;

d) we are required to comply with an order, instruction or request of any government body, any emergency service organisation, or any other person or organisation with the appropriate authority; or

e) We can charge you the reasonable costs incurred by us for reconnecting you to the services

When the agreement ends

23) We can cancel this agreement immediately if any of the following happens:

a) You break an important condition of this agreement or a number of less important conditions;

b) You break a less important condition of this agreement and does not put it right within 7 days of us asking them to;

c) the service providers no longer makes the service available;

d) your service has been suspended or disconnected under 7(a)(ii), (iii), (iv) or (v); or

e) any of the provisos for use of the services set out in 3(b)(i), (ii), (iii), (iv) and (v) are not complied with.

24) You can cancel this agreement at any time for any reason.

25) If this agreement is cancelled we will ask the issuer of your credit voucher to suspend it andyou will not be able to use the voucher thereafter to acquire services from us.

26) If you decide to cancel this agreement because charges are increased, services are withdrawn or there is any other change to this agreement, and your account is in credit, you will need to apply to the issuer of the credit voucher and ask them to refund the amount of such unused credit. In order to claim your refund you must contact Customer Services within 30 days of the date of the change with the original receipt for the purchase of the Credit Voucher. A service charge of £5 will be made for refunding credit.

General

27) You may not assign or delegate or otherwise deal with any of your rights or obligations under this Agreement without the express consent of Irish Continental Technology Limited, such consent not to be unreasonably withheld. Irish Continental Technology Limited shall have the right to assign or otherwise delegate all or any of its rights and obligations under this Agreement go any other person

28) This agreement is governed by the laws of Ireland and is subject to the jurisdiction of the Irish Courts.

How to make a call:

  1. Purchase a First National card from your local shop
  2. Dial the access number as printed on the card
  3. Enter the PIN number as printed on the card
  4. Dial the number you want to call
  5. To make a second call just press ##

What access number to use:

01 437 3160 access number

This number gives you the most talk time on your First National phone card. However you may be billed for the price of the 01 call. Check with your phone provider to see if you have free calls to 01 numbers as part of your price plan.

1800 938 708 access number

This Freephone access number is best used if you are not the bill payer for the phone you are making the call from. However you will get less talk time on your First National phone card that if you used the 01 437 3160 access number. It is not suitable for making calls from a mobile phone (due to the high surcharges levied by the mobile operators).

1512 277 8044 access number

When you use this First National access number from an O2 mobile phone you will get the same great rates as with the 01 access number. Calls made using this 1512 number will be charged 39 cent per call by 02. This service is only available on the 02 network.
